General Terms and Conditions

1 Scope of application and definition of terms

(1) The following General Terms and Conditions apply exclusively to all offers, product presentations, orders, deliveries and services between Bettervita Nutricosmetics GmbH and a consumer in the version valid at the time of the order.

(2) "Consumer" within the meaning of these terms and conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to a commercial, entrepreneurial or other independent professional activity.

(3) The goods on offer in our online shop www.bettervita.ch are aimed exclusively at buyers who have reached the age of 18.

(4) Business relationships between Bettervita Nutricosmetics GmbH and entrepreneurs and/or legal entities are expressly not handled via the internet shop www.bettervita.ch.

(5) Resale of our goods as an intermediary is not permitted

(6) The contract language is exclusively German.

2 Conclusion of a contract, storage of the contract text

(1) The following provisions on the conclusion of contracts apply to orders placed via our online shop www.bettervita.ch.

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods in the online shop. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

(4) The following applies upon receipt of an order in our online shop:

As a consumer, you submit a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

  • 1) Selection of the desired goods
  • 2) Confirm your selection by clicking on the "Order" button
  • 3) Checking the details in the shopping basket
  • 4) Press the "Checkout" button
  • 5) Option a): If you already have an account, you can process the transaction via your account by entering your login details (e-mail address and password) Option b): You do not have an account yet, now you can register (e-mail address and password) and, after successful registration, process the transaction via the newly created account Option c): You do not have an account and do not want to set one up. This is not absolutely necessary. You can continue your order process as described in the menu navigation.
  • 6) After carrying out point 5), you will be asked to re-check or correct the data you have entered.
  • 7) By clicking the "Buy" button, you submit a binding purchase offer
  • 8) Before carrying out the confirmation, by clicking on the "Agree" button you declare your agreement to the terms and conditions set out in the respective valid version of the
    • a) General Terms and Conditions of Bettervita Nutricosmetics GmbH including the cancellation policy
    • b) Privacy policy
  • 8) The binding dispatch of the order to Bettervita Nutricosmetics GmbH then takes place.

As a consumer, you can return to the website on which the information you have entered is recorded and correct input errors or cancel the order process by closing the Internet browser before submitting the binding order by pressing the "Back" button in the Internet browser you are using after checking your details.

After sending a binding purchase offer, we confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this e-mail we accept your offer and send you the order data you have entered.

The invoice is sent with the delivery of the goods.

(5) Storage when ordering via our online shop:

We will send you the order details by e-mail.

You can view the GTC including the cancellation policy and the privacy policy at any time at www.bettervita.ch.

If the order was placed via a registered customer account, the order data can be seen on this customer (e-mail address / password).

If the order is placed without a customer account, your order data will no longer be accessible via the Internet for security reasons; the basis of the order and processing is then the confirmation sent by e-mail (acceptance of the purchase contract).

3 Prices, shipping costs, due date, payment

(1) The prices stated in the online shop include the applicable statutory VAT and other price components (customs duties and applicable taxes).

Any shipping costs are not included and will be shown separately if incurred.

Deliveries within Switzerland and the EU or third countries are subject to a charge. The costs will be determined and charged on a case-by-case basis.

(2) The invoice amount is due immediately.

(3) The consumer has the option of paying by PayPal, credit card (Visa, MasterCard), e-banking or TWINT.

4 Delivery

(1) Unless clearly stated otherwise on our website or in the product description, all items offered by us are ready for immediate dispatch.

(2) Unless otherwise agreed, the goods shall be delivered from our warehouse to the address specified by the consumer.

(3) Information about a delivery period is non-binding, unless the delivery date has been agreed as binding in exceptional cases.

(4) You will also receive the invoice together with the ordered goods.

5 Retention of title

The delivered goods remain the property of Bettervita Nutricosmetics GmbH until the purchase price has been paid in full.

6 Liability for defects

If there is a defect in the purchased item, the statutory provisions shall apply. An assignment of these claims by the consumer is excluded.

Further claims - irrespective of the legal grounds - are excluded.

The limitation of liability shall not apply if the cause of damage is based on intent or gross negligence. Furthermore, they shall not apply if legal claims are asserted by you as the customer.

7 Right of cancellation

Cancellation policy

In the event that you are a consumer, i.e. you are a natural person who concludes a purchase transaction for purposes that can predominantly be attributed neither to your commercial nor your independent professional activity, you have a right of cancellation in accordance with the following provisions:

Right of cancellation

As a consumer, you are entitled to a right of cancellation in accordance with the statutory provisions. Please note that our products are sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery. Therefore, the right of cancellation is excluded as soon as you have removed the seal by opening the product packaging.

You can cancel the contract with Bettervita Nutricosmetics GmbH via written text (e-mail) within 14 days from the date of the order.

To exercise your right of cancellation, please send a clear declaration (e-mail) of your decision to cancel this contract to:

Timely dispatch of the cancellation or the goods is sufficient to comply with the cancellation period. The goods must be demonstrably returned to the above address.

Consequences of cancellation

In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered.

We shall reimburse to you all payments received from you in respect of the cancelled contract, including the costs of delivery (with the exception of the supplementary costs which may arise if you have chosen a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 30 days from the day on which we are informed about your decision to cancel the contract. For the refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

The invoice amount will be refunded after we have received the goods back and checked them for damage. You must return or hand over the goods to us immediately and in any case within 14 days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you can prove that you have dispatched the goods before the 14-day period has expired.

Goods that can be sent by parcel post are to be returned at your own risk. You must bear the regular costs of returning the goods if the delivered goods correspond to those ordered, have not been opened and are in the original condition.

The right of cancellation does not apply to delivery

  • sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed before delivery

8 Transport damage

If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us as soon as possible.

9 Contract language

The contract language is exclusively German.

10 Place of fulfilment, place of jurisdiction

The place of fulfilment and jurisdiction for all claims and legal disputes arising from this contractual relationship is the registered office of Bettervita Nutricosmetics GmbH.

11 Applicable law

Swiss law applies.

12 Alternative dispute resolution

The EU Commission has provided a platform for out-of-court disputes. This gives consumers the opportunity to resolve disputes in connection with their online order without having to go to court. The dispute resolution platform can be accessed via the external link http://ec.europa.eu/consumers/odr/.

We endeavour to settle any differences of opinion arising from the contract by mutual agreement. Furthermore, we are not obliged to participate in arbitration proceedings and cannot offer you participation in such proceedings.

13 Keys Provisions

The invalidity of one or more provisions of these GTC shall not affect the validity of the remaining provisions.

We may assign all contracts with you and our rights and obligations arising therefrom in whole or in part to another legal entity, in particular to an affiliated company or in connection with a corporate transaction or an asset deal.
